By placing an order for this product, you acknowledge that you have read, understood, and agreed to the following terms.

PRE-ORDER & FINAL SALE

This item is a made-to-order/pre-order collectible. Except where cancellation, return, replacement, or refund rights are required by applicable law, all sales are final once an order is placed.

Changes of mind, accidental purchases, purchasing the incorrect version, failure to verify compatibility, or other buyer errors do not qualify for cancellation, return, exchange, or refund except where required by applicable law.

Nothing in this policy limits any cancellation, refund, or other right that cannot legally be waived.

SHIPPING STARTS

Shipping Starts: September

Orders are expected to begin shipping during September. This represents our current good-faith production and fulfillment schedule and does not guarantee that every order will ship or arrive on a specific date in September.

Orders may ship in batches as products are completed and pass quality control. Production, manufacturing, material, supply, quality-control, carrier, or other unforeseen delays may affect individual orders.

If we are unable to ship within the timeframe represented at the time of purchase, customers will be provided any notice, cancellation opportunity, or refund required by applicable law.

PRODUCT IMAGES & FINAL APPEARANCE

Product images may include digital renders, prototypes, promotional photographs, or pre-production examples intended to represent the final product.

Minor differences may occur in color, finish, texture, surface appearance, dimensions, fit, detailing, or other cosmetic characteristics between promotional images and the final manufactured product.

Such minor differences that do not materially impair the intended functionality of the product are not considered defects.

HANDCRAFTED / SMALL-BATCH PRODUCT

Each piece is individually or small-batch produced and may be individually finished.

Minor variations between pieces are normal. Small variations in color, surface texture, finish, layer lines, sanding, paint application, or other characteristics inherent to the manufacturing and finishing process are not considered defects unless they materially affect the intended functionality of the product.

INSPECTION UPON DELIVERY

Customers should inspect their order promptly after delivery.

If an item arrives materially damaged, defective, incorrect, incomplete, or with an edge or point that appears unreasonably sharp or unsafe to handle, please stop handling the affected component and contact Swags Customs promptly with your order number and clear photographs of the item and packaging.

Depending on the circumstances, Swags Customs may provide handling instructions, arrange for adjustment, replacement, or return of the affected component, or provide a refund or other appropriate remedy.

This provision does not limit any rights or remedies available under applicable law.

⚠️ SHARP PARTS & HANDLING WARNING

PLEASE LOOK OVER THE PRODUCT AND HANDLE WITH CARE.

This product is a detailed adult collectible and is not intended as a toy. Due to the design and manufacturing of certain components, some parts—including hair, accessories, edges, or other fine details—may have sharp or pointed tips.

Handle all components carefully. Avoid pressing sharp or pointed components against the skin and exercise particular care when installing, removing, posing, or displaying them.

Keep this product and all components away from children and pets.

The customer is responsible for following these warnings and using reasonable care when handling, installing, displaying, or modifying the product.

To the fullest extent permitted by applicable law, Swags Customs is not responsible for injury or damage resulting from misuse, improper handling, excessive force, unauthorized modification, or failure to follow the warnings and handling instructions provided with the product.

If a component arrives with an edge or point that you believe is unreasonably sharp or unsafe to handle, do not continue handling, installing, sanding, or modifying it. Contact Swags Customs before modifying the product.

Swags Customs may, as appropriate, provide handling instructions, arrange for the affected component to be returned for adjustment or replacement, or provide a refund or other appropriate remedy.

Nothing in this warning excludes or limits liability or consumer rights that cannot legally be excluded or limited.

HANDLING & CUSTOMER-CAUSED DAMAGE

This product contains small, detailed, and potentially delicate components and must be handled with appropriate care.

Damage may result from excessive force, bending, dropping, forcing components together, improper installation or removal, modification, sanding, cutting, heating, exposure to excessive temperatures or chemicals, improper storage, or other misuse.

To the fullest extent permitted by applicable law, Swags Customs is not responsible for damage resulting from misuse, improper handling, improper installation, unauthorized modification, normal wear, or customer-caused damage after delivery.

MODIFICATIONS

Do not attempt to sand, cut, heat, reshape, drill, or otherwise modify a sharp or pointed component unless you understand how to do so safely.

Any sanding, drilling, cutting, painting, heating, reshaping, gluing, modification, or alteration voluntarily performed by the customer is undertaken at the customer’s own risk.

To the fullest extent permitted by applicable law, Swags Customs is not responsible for damage or injury resulting from improper or unauthorized modification, misuse, or failure to follow provided safety and handling instructions.

COMPATIBILITY & FIT

This product is designed for the compatible figure(s) identified in the product listing.

Customers are responsible for verifying that they are purchasing the correct version for their intended figure before completing the order.

Fit may vary slightly because of manufacturing tolerances, variation between individual base figures, prior modifications to the customer’s figure, or normal variation inherent in small-batch production.

Compatibility means that the product is designed for the listed figure or configuration; it does not guarantee identical fit characteristics across every individual copy of a third-party figure.

COLLECTOR PRODUCT / SMALL PARTS

This product is intended for adult collectors and is not designed or intended for use by children.

The product may contain small, removable, pointed, sharp, or delicate components that can present choking or other hazards.

Keep this product and all components away from young children and pets.

SHIPPING ADDRESS

Customers are responsible for providing a complete and accurate shipping address at checkout.

Swags Customs is not responsible for delivery problems resulting from incorrect or incomplete shipping information supplied by the customer, except as otherwise required by applicable law.

If an order has not yet shipped, customers should contact Swags Customs as soon as possible regarding an address correction. Address changes cannot be guaranteed after fulfillment has begun.

SHIPPING, LOSS & DELIVERY

Once an order ships, tracking information may be provided when available.

If a shipment is lost or materially damaged while in transit, contact Swags Customs so that we can assist with the applicable carrier process.

To the fullest extent permitted by applicable law, Swags Customs is not responsible for theft, loss, or damage occurring after a carrier has confirmed delivery to the shipping address supplied by the customer, except where caused by Swags Customs or where applicable law provides otherwise.

Nothing in this provision limits rights or remedies that cannot legally be waived.

WARRANTIES

Except to the extent prohibited by applicable law, no additional express warranty is created by these terms beyond representations expressly made in the applicable product listing.

Any disclaimer or limitation of implied warranties applies only to the extent permitted by applicable law.

Nothing in these terms excludes, restricts, or modifies any warranty, consumer protection, or statutory right that cannot legally be excluded, restricted, or modified.

ASSUMPTION OF RISK

To the fullest extent permitted by applicable law, the customer assumes the ordinary risks associated with handling, installing, modifying, posing, displaying, and using delicate collectible components after delivery, including ordinary risks associated with clearly disclosed pointed or sharp design elements.

This provision does not apply to liability that cannot legally be waived.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Swags Customs and its owners, employees, contractors, and affiliates shall not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from or relating to the purchase, possession, installation, modification, use, misuse, or inability to use this product.

To the fullest extent permitted by applicable law, the total aggregate liability of Swags Customs arising from or relating to the purchase of this product shall not exceed the amount actually paid to Swags Customs for the product giving rise to the claim.

These limitations do not apply to fraud, willful injury, violations of law, or any other liability that cannot legally be excluded or limited.

INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Swags Customs and its owners, employees, contractors, and affiliates from third-party claims, liabilities, damages, and reasonable expenses arising from your misuse, unauthorized modification, resale representations, unlawful use of the product, or violation of these terms.

This provision does not require indemnification for conduct for which indemnification cannot lawfully be required.

SEVERABILITY

If any provision of these terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or, where appropriate, severed from these terms.

The remaining provisions will remain in effect to the extent permitted by law.

NO WAIVER

Failure by Swags Customs to enforce any provision of these terms in a particular instance does not constitute a waiver of the right to enforce that provision or any other provision in the future.

GOVERNING LAW

These terms and purchases made through Swags Customs shall be governed by and interpreted in accordance with the laws of the State of California, without regard to its conflict-of-law principles.

Nothing in this provision is intended to deprive a customer of mandatory consumer protections or rights provided by applicable state or federal law.

ENTIRE PRODUCT AGREEMENT

These product-specific terms, together with the product listing, applicable store policies, and Swags Customs Terms of Service in effect at the time of purchase, constitute the terms applicable to the purchase of this product.

If a product listing contains product-specific information that differs from general information contained here, the product-specific information will control to the extent permitted by law.
